Aqab Nikah Ke Waqt Yeh
Shart lagany ke kuch mohar
waalid bhi le ga
Kuch maashron mein yeh
aadat aur rasam hai ke larki ka waalid Aqab nikah ke waqt larki ke mohar sath
mohar mein se khud bhi lainay ki shart lagaata hai, to kya waalid ko yeh haq
haasil hai?
Jawab
Alhmd lillah
Ibn Qadama مقدسی Rehma ALLAH taala kehte hain :
Masla :
Aur jab shadi is shart par
ho ke aik hazaar larki ko aur aik hazaar is ke walida ko day ga, yeh jaaiz hai,
agar is ne dukhool se qabal hi Talaq day di.
Mujmal tor par is maamla
mein aurat ke waalid ke liye jaaiz hai ke woh beti ke مہرمیں
se –apne liye bhi kuch makhsoos karne ki shart rakhay .
Ishaq Rehma ALLAH taala ka
yahi kehna hai. aur yeh bhi riwayat kya gaya hai ke masrook Rehma ALLAH taala
ne jab apni beti ki shadi ki twapne liye das hazaar ki shart rakhi thi, aur un
das hazaar ko msakin aur hajj mein taqseem kardiya aur phir khawand ko kehnay
lagey apni biwi ko tayyar karo. Ali ban Hussain Rehma ALLAH taala se bhi aisi
riwayat millti hai .
Aur Ata , taaos, عکرمہ, عمربن abdalaziz, Sauri , ابوعبید رحمہم ALLAH kehte hain ke mukammal mohar aurat
ka hi hoga, is liye mohar to sirf aurat ke liye wohi wajib hai kyunkay yeh is
ke –apne aap کوسپرد karne ke badla mein
hai .
Lekin hamari Daleel Shoiab
alaihi salam ke qissa mein ALLAH taala ka farmaan hai :
{ mein tairay sath un do
baityon mein se aik ka nikah is shart par karna chahta hon ke meri aath baras
tak khidmat karo }, twanhon ne mohar mulazmat muqarrar ki ke bakriyan churani
hain aur yeh shart –apne liye lagai .
aur phir waalid ke liye
jaaiz hai ke woh aulaad ka maal le le, is ki Daleel nabi sale ALLAH alaihi
wasallam ka farmaan hai :
( to aur tera maal tairay
waalid ka hai ) .
Aur aik hadees mein yeh
farmaya :
( bilashuba tumhari aulaad
tumhari sab se behtar kamaai hai lhza tum un ke maal se khao ) ابوداؤد, sunan tirmizi, imam tirmizi ne usay husn
qarar diya hai .
To is terhan agar waalid
mohar mein se kuch khud lainay ki shart lagaata hai to woh beti ke maal se lena
ho ga jo kay is ke liye jaaiz hai, kyunkay waalid jo chahay le aur jo chahay
nah le, jab waalid baghair kisi shart ke maalik ban sakta hai twasi terhan
shart se bhi le sakta hai .

ilawa aulia mein se koi aur shart lagaye maslan dada, nana, bhai, chacha to
phir shart baatil hogi, imam Ahmed ne yahi kaha hai avr mkml mohar beti kohi
